Three common lines of inquiry
Product cases often examine design, manufacture and instructions or warnings. The standards and available defenses depend on state law and the product. A failure after an accident does not by itself establish that the failure caused the accident; physical evidence and recorded data can be decisive.
Preserve the configuration
Record model and serial numbers, component identifiers, software build, repair history, service bulletins, modifications and any post-incident handling. An inspection protocol may be needed so potentially responsible parties can evaluate the same evidence without altering it.
Account for aviation oversight
FAA certification sets important technical context, but an approval is not a one-sentence answer to every civil claim. An attorney and technical experts should examine the specific standard, product, failure mode and governing jurisdiction. Avoid promising that a certification either guarantees safety or bars recovery.
